You also agree not to interfere with the servers or networks underlying or connected to this website or our services or to violate any of the procedures, policies or regulations of networks connected to this website.

3.2 All content and programming of the website is our property. Except as may be permitted by law, notwithstanding contractual prohibition, you may not reproduce, modify, copy, de-compile or reverse engineer any of the materials, software or content on the website without our written permission. Use of the website and social media platforms is restricted to personal, non-commercial use only.

6. order process

6.1 The advertising of products on our website constitutes an “invitation to treat” rather than a contractual offer.

6.2 No contract will come into force between you and us unless and until we accept your order in accordance with the procedure set out in this Section.

6.3 To enter into a contract through this website to purchase products from us, the following steps must be taken:

6.3.1 You must add the products you wish to purchase to your basket;

6.3.2 You will then need to go to your basket and follow the on-screen steps (including providing payment and delivery information) to complete your order.

6.3.3 Our order process allows you to check and amend any errors before submitting your order to us. Orders may be processed as soon as they are received so you may not be able to change or cancel an order once it has been confirmed. We cannot accept responsibility if incorrect details are given.

6.3.4 We will then either send you an order confirmation by email (at which point your order will become a binding contract) or we will confirm by email that we are unable to meet your order.

7.1 All products shown on our site are subject to availability. If any product you have ordered is not available, we will contact you to let you know and will refund your payment.

7.2 The images of the products on our site are for illustrative purposes only and your products may vary from those images.

7.3 We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

7.4 We may periodically change the products available on our website, and we do not undertake to continue to supply any particular product or type of product.

7.5 We will provide you with information about each product’s ingredient and nutritional information. We will also let you know if a product contains any of the following listed ingredients/substances which may affect people with allergies or intolerances:

7.5.1 Cereals containing gluten and gluten products;

7.5.2 milk/lactose;

7.5.3 eggs;

7.5.4 peanuts;

7.5.5 nuts (i.e almond, hazelnut, walnut, cashew, pecan nut, Brazil nut, pistachio nut, macadamia nut and Queensland nut);

7.5.11 This information will also be shown on each product’s “full ingredients” on our website and our product packs will contain this information printed on them.

7.6 As all of our products are prepared in the same environment, we are unable to guarantee that our products are completely free from any of the ingredients / substances / allergens listed above so always assume there may be traces of these allergens / ingredients / substances.

7.7 Optional tools and services

7.7.1 We may provide you with access to third-party tools and services over which we neither monitor nor have any control nor input.

7.7.2 You acknowledge and agree that we provide access to such services and tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement.

7.7.3 We shall have no liability whatsoever arising from or relating to your use of optional third-party tools and services. Any use by you of optional tools and services offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools and services are provided by the relevant third-party provider(s).

7.7.4 We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

7.8 Free Shaker and/or T-shirt with your first purchase

7.8.1 Whilst it is possible to add the item(s) “Free T-Shirt or Shaker” to your basket, and whilst this may then appear in order and shipping confirmations, this does not guarantee that you will receive these items. The free t-shirt and shaker can only be received with first time orders of dare motivational shake and cannot be combined with other bundles or discounts. By adding this option to your basket, you are agreeing that this will only be fulfilled with your first order of dare motivational shake and not for any subsequent orders, regardless of the item being in your basket or not.

8. prices

8.1 Our prices are quoted on our website.

8.2 Prices for our products are as quoted on our site and may change from time to time, but changes will not affect any order after we have dispatched the products relating to that order.

8.3 All amounts stated in these terms and conditions or on our website are stated inclusive of VAT.

8.4 Our Website contains a large number of products and it is always possible that, despite our best efforts, some of the products listed may be incorrectly priced. We will normally verify prices as part of our order procedures. If a product’s correct price is higher than the price stated on our website we may at our discretion reject your order without liability to you and notify you of such rejection. We are under no obligation to supply products to you at an incorrect (lower) price, even after we have sent you an order confirmation, if the pricing error is obvious and unmistakable and could reasonably have been recognised by you as a pricing error.

8.5 In addition to the price of the products, you may have to pay a delivery charge, which will be notified to you as part of the checkout process and before the order is confirmed.

9. free or discounted offers

9.1 Free or discounted introductory offers are only available to new users of the website. Except where expressly stated, previous users or trialists of the website do not qualify for an additional special offer.

9.2 Except where otherwise stated, discounts and credits are available only once to any one person.

9.3 Except where otherwise stated, discounts and credits cannot be used in conjunction with any other offers.

9.4 You must have internet access and valid payment details to redeem a free or discounted offer.

9.5. Only dare vouchers and discount codes specifying that they can be used on the dare shop are valid for use on the www.dare-liberate.co.uk/shop website.

9.6. dare reserves the right to vary the conditions of use or to withdraw vouchers, discounts and credits at any time.

10. payments

10.1 You must, during the checkout process, pay the prices of the products you order.

10.2 Where payment is made using the card registered to your dare account, payment services are provided by Dare Group Limited.

10.3 Where the PayPal option is selected, payment services are provided by PayPal.

10.4 Payment is taken for all orders prior to the order being dispatched so please ensure that all details given to us are correct. We cannot accept responsibility for an order being held back as a result of incorrect or invalid payment details being given nor can we accept responsibility if incorrect address details are given and the order sent to an incorrect address.

11. deliveries

11.1 Our policies and procedures relating to the delivery of products are set out in this Section 11.

11.2 Our products can only be delivered to addresses within the United Kingdom (including Northern Ireland). We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis.

11.3 We will arrange for the products you purchase to be delivered to the delivery address you specify during the checkout process. We always ship to the exact address details you enter, so make sure to check you’ve given us the correct information before you place your order. If you’re unsure, try the Post Office address finder as we can’t accept liability for late or failed deliveries due to an incorrect address.

11.4 standard deliveries

If you select standard delivery at checkout, your order will usually be sent via Royal Mail’s standard service. Order tracking is not available for this service. Actual delivery times may vary according to :

11.4.1 our stock availability;

11.4.2 your delivery address;

11.4.3 when you make your selection; and

11.4.4 circumstances impacting delivery by the postal service.

11.4.5 You will not hold us responsible for any delays, outside our control, which relate to the delivery of orders

11.4.6 We reserve the right to use alternative delivery methods without prior notification.

11.4.7 We will use reasonable endeavours to deliver your products within 7 days following the date of the order confirmation; however, we cannot guarantee delivery by this date.

11.4.8 We do guarantee that unless there are exceptional circumstances all deliveries of products will be dispatched within 30 days following the later of receipt of payment and the date of the order confirmation.

11.4.9 If your order does not arrive, please let us know on orders@daremotivation.com. Be sure to include your unique order ID number from your confirmation email when getting in touch.

11.4.10 If your delivery parcel does not fit through your letterbox and you are out when it is delivered, your postal carrier should leave a card at the address with information about collection or re-delivery. The postage provider will hold the box for 7 days before returning it to us and it is your responsibility to contact them to arrange receipt of the box as soon as you can. Due to the perishable nature of the food, we cannot be held responsible for refunding or replacing the box if this process has not been followed.

11.4.11 If you have selected standard delivery but not received your products and have not been left a card to say that the delivery has been attempted, please contact Royal Mail to check whether they have the box. You can find your local delivery office here: www.royalmail.com/delivery-and-collectionoffice. If Royal Mail are not holding the box for you, please contact us on orders@daremotivation.com to report the problem. Be sure to include your unique order ID order number from your confirmation email when getting in touch.

11.4.12 A reasonable allowance of time will need to be made for any delivery delays before we are able to take action. We reserve the right to cancel your account and transactions with us if it becomes apparent that, in our sole opinion, the postal service in your area is too unreliable.

12. cancellation and returns

12.1 We strive to deliver our products to you in perfect condition, however if your products arrive damaged or faulty, then we always want to know about it. Please contact us on orders@daremotivation.com

12.1.1 We retain the right to request a return of any faulty goods by recorded delivery to:

and the product will be inspected. If we request recorded delivery then we will pay for the cost of the postage on provision of the postage receipt.

12.1.2 If the fault is agreed, a full refund, replacement or voucher will be given for the returned goods. If a refund is agreed then we will refund money using the same method used to make the payment, unless you have expressly agreed otherwise.

12.1.3 Nothing in this section affects your legal rights.

12.2 Unfortunately, damaged and faulty products are the only reasons for which we can offer a refund or replacement for our products. Due to the perishable nature of some of our products, you do not otherwise have a right to cancel your order or any contract between us and we are not otherwise able to offer refunds or allow for a return of those items, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

12.3 We may cancel a contract under these terms and conditions by written notice to you if we are prevented from fulfilling that contract by any event beyond our reasonable control, including without limitation any technical error, any unavailability of raw materials, components or products, or any power failure, industrial dispute affecting any third party, governmental regulations, fire, flood, disaster, riot, terrorist attack or war.

12.4 We reserve the right to terminate or restrict your use of our service, for any or no reason whatsoever. One reason that we may do so is if we believe that you are in breach of any obligation under these Terms and Conditions. If we terminate your use of our service as a result of a breach of any obligation under these Terms and Conditions, such termination would be immediate and may be without notice.

13. warranties, representations

13.1 You warrant and represent to us that:

13.1.1 you are legally capable of entering into binding contracts;

13.1.2 you have full authority, power and capacity to agree to these terms and conditions;

13.1.3 all the information that you provide to us in connection with your order is true, accurate, complete and non-misleading; and

13.1.4 you will be able to take delivery of the products in accordance with these terms and conditions and our delivery policy.

13.2 We warrant to you that:

13.2.1 we have the right to sell the products that you buy;

13.2.2 the products we sell to you are sold free from any charge or encumbrance, except as specified in these terms and conditions;

13.2.3 you shall enjoy quiet possession of the products you buy, except as specified in these terms and conditions;

13.2.4 the products you buy will correspond to any description published on our website; and

13.2.5 the products you buy will be of satisfactory quality.

13.3 All of our warranties and representations relating to the supply of products are set out in these terms and conditions. To the maximum extent permitted by applicable law and subject to Section 10.1, all other warranties and representations are expressly excluded.

14.2 The limitations and exclusions of liability set out in this Section 10 and elsewhere in these terms and conditions:

14.2.1 are subject to Section 10.1; and

14.2.2 govern all liabilities arising under these terms and conditions or relating to the subject matter of these terms and conditions, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty, except to the extent expressly provided otherwise in these terms and conditions.

14.3 We will not be liable to you in respect of any losses arising out of any event or events beyond our reasonable control.

14.3.1 We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

14.3.2 We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

14.3.3 You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

14.3.4 In no case shall Dare, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

15.1 You agree to indemnify, defend and hold harmless Dare and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

16. assignment

16.1 You agree that we may assign any of our rights and/or transfer, sub-contract or delegate any of our obligations under these Terms and Conditions. These Terms and Conditions are personal to you and you may not assign any of your rights or transfer, sub-contract or delegate any of your obligations under these Terms and Conditions.

17. no waivers

17.1 No breach of any provision of a contract under these terms and conditions will be waived except with the express written consent of the party not in breach.

17.2 No waiver of any breach of any provision of a contract under these terms and conditions shall be construed as a further or continuing waiver of any breach of that provision or any other provision of that contract.

18. severability

18.1 If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect.

18.2 If any unlawful and/or unenforceable provision of these terms and conditions would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

19. third party rights

19.1 A contract under these terms and conditions is for our benefit and your benefit, and is not intended to benefit or be enforceable by any third party except where a third party acts on our behalf at our request and with our express written consent.

19.2 The exercise of the parties’ rights under a contract under these terms and conditions is not subject to the consent of any third party.

20. entire agreement

20.1 Subject to Section 10.1, these terms and conditions, together with the Privacy policy and other terms, shall constitute the entire agreement between you and us in relation to the sale and purchase of our products and shall supersede all previous agreements between you and us in relation to the sale and purchase of our products.

21. law and jurisdiction

21.1 These terms and conditions shall be governed by and construed in accordance with English law. Any disputes relating to these terms and conditions shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.

22.1 We will not file a copy of these terms and conditions specifically in relation to each user or customer. We recommend that you consider saving a copy of these terms and conditions for future reference.
